Terms of Service

Wisebit Pay Ltd is incorporated in Canada with its head office located at 1st Floor, Ste 8 – 415 Dunedin St, Victoria, BC V8T 5G8. We offer foreign exchange, money transferring, issuing and redeeming of money orders, virtual currency dealing, payment service provider (PSP) solutions and cheque cashing.

You must be at least the age of majority in your jurisdiction and legally able to enter into a binding contract. You must provide accurate identification and information sufficient for us to complete Know Your Customer (KYC) verification in accordance with Canadian law.

As a FINTRAC-registered MSB, we are required to identify our clients, keep records of transactions and report certain transactions to Canadian authorities. By using our services, you consent to the collection, verification and processing of identification and transaction information as required by the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and associated regulations.

Wisebit Pay offers the following regulated services: (a) foreign currency exchange; (b) domestic and international money transfers; (c) issuing and redeeming money orders; (d) buying, selling and exchanging virtual currency; (e) payment service provider services for merchants; and (f) cheque cashing. Service availability, limits and pricing may vary by jurisdiction and client profile.

Fees and exchange rates are disclosed at the time of the transaction. Rates are indicative until a transaction is confirmed. Settlement times depend on the payment method, corridor, banking partners and compliance review. Wisebit Pay is not liable for delays caused by third-party financial institutions or regulatory hold requirements.

You agree not to use our services for any unlawful activity, including but not limited to money laundering, terrorist financing, fraud, evasion of sanctions, unlicensed gambling or the purchase of goods and services prohibited under Canadian law. We may refuse, freeze, delay, reverse or report any transaction we reasonably suspect to be non-compliant.

Virtual currency values are highly volatile and transactions on public blockchains are generally irreversible. You acknowledge that you understand these risks and are solely responsible for the wallets, keys and addresses you provide. Wisebit Pay is not responsible for losses arising from incorrect addresses, network fees, forks or third-party wallet failures.

To the maximum extent permitted by law, Wisebit Pay's aggregate liability arising out of or relating to the services is limited to the fees paid by you to Wisebit Pay in respect of the relevant transaction. We are not liable for any indirect, incidental, consequential or punitive damages.

You agree to indemnify and hold harmless Wisebit Pay, its directors, officers, employees and agents from any claim, liability, loss or expense arising from your breach of these Terms or your misuse of the services.

We may suspend or terminate your access to any service at any time, with or without notice, where required by law, regulation or where we determine that continued service would present a legal, compliance or reputational risk.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You submit to the exclusive jurisdiction of the courts of British Columbia for any dispute arising under these Terms.

We may update these Terms from time to time. The current version will always be posted on our website. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
